Art ToS
This comes across as a bit blunt, but it's the technical and legal side of things. Please read.These are terms set between you ("you", "your") and Raketh ("I", "me", "my"), covering acquisition of my artwork. By submitting references to obtain art from me, you're acknowledging and agreeing to the below, whether you read this in full or not:
1. General
[1.1] You are granting me permission to use your character (also referred to as "fursona", "sona", or "OC") in the type(s) of artwork specified in the Google Form you submit to me.
[1.2] I retain ownership of the art. You retain ownership of your character.
[1.3] Art is for personal use only. By personal use, this means you can repost the art elsewhere, redistribute, use as a banner/profile/background, crop, edit (without violating the Acceptable Character Policy), print out, or use as reference material. Basically, as long as you're not claiming the art as your own or selling it, you're good.
[1.4] Unless specifically stated otherwise, my art is free and of no cost to you. I do not expect payment or anything in return - there are no strings attached other than agreeing to this ToS and abiding by its terms.
[1.5] You must be eighteen (18) years old or above.
[1.6] I operate a tip jar, but using it is optional. Tipping is an entirely personal gesture and has no bearing on art or future interaction. Whilst I of course massively appreciate it and am grateful you'd even want to throw coin my way, tipping will not be received with favouritism. Similarly if you do not tip, I won't mind or be offended, nor does it alter future art prospects.
[1.7] Practice art is not guaranteed, and is subject to my whims, mood, and ideas.
[1.8] I am not obligated to draw you, and can opt to pass on your character for any reason. The reason does not have to be disclosed.
2. Submission & Process
[2.1] To give everyone a fair shot at getting art, each time I complete one (1) piece of art for you (regardless of type), you will not be eligible for further art until after a minimum period of six (6) months. An exception to this clause may be granted if there's lack of other suitable people to draw in that time frame.
[2.2] Any personal data submitted for art via Google Forms will be handled in accordance with GDPR. Your Forms response will never be shared by me and handled with absolute privacy. Your Forms response can also be deleted on request.
[2.3] It is your responsibility to provide accurate reference sheets and/or supporting documentation/images, update them when necessary, and ensure it is accessible. I will only draw from what is provided. Discord links have proven to be almost always problematic, and therefore are not accepted.
Addendum to 2.3: I will not be checking your links for you on request, nor will I be chasing people up about broken ones. You are solely responsible for providing and maintaining functional and accessible references. If using Google Drive, make sure your folder is set to shared and is not private. If using an image sharing website (such as Imgur or FurAffinity), periodically check to ensure that the image is not 404’d or deleted. If a Twitter link, the account shouldn't be locked or private. Also check to make sure you’ve copied your link into the form correctly and haven’t missed out part of the URL.
[2.4] NSFW ref sheets are fine to submit.
[2.5] Only providing a written character description is not accepted. Suitable pre-existing art, ref sheet, or visual references of your character are a must. A written description can accompany these, but I will not work from words only.
[2.6] You must have your character depicted in the submitted reference(s) - I do not offer a design service. Please do not send me various art or screenshots of random individuals and expect me to piece together your character from them.
[2.7] AI generated images for reference are not accepted.
[2.8] Please make the references suitable for purpose. For example, if you're getting paw art, don't only provide me with a waist up ref. I must be able to make a reasonable determination of your character's details and colours from the provided information. If details are vague, then (depending on severity) I'll either make a "best guess" or simply invoke clause 1.8.
[2.9] In the event I overlooked something minor (such as omitting a marking or piercing) from the submitted material, I'll aim to fix it. Upon receipt of the art, you have seven (7) days to request a one-time fix. Details that were not originally provided or were open to interpretation are not covered under this clause.
[2.10] The submission form provides information on what will be drawn and my FurAffinity gallery is representative of the results. It is your responsibility to read and understand what you might receive before submitting a ref, and to fill in the form correctly.
[2.11] For art practice, WIPs are not provided, nor will you have any input other than what you submitted in the Google Form. Any WIPs or processes shared are at my discretion.
[2.12] I will colour sample your ref sheet to match colours of the character. However please be aware that they may not be an exact match in the final piece - colours change in appearance depending on lighting, environment, and shading!
3. Completion & Usage
[3.1] If reuploading artwork, please make the effort to tag / link to either my FA, Twitter, or Bluesky. This is not enforced, but it's the least you can do.
[3.2] In the unlikely event you desire to use the art featuring your character for commercial purposes or financial gain, please ask beforehand. Agreements / terms will be discussed on a case-by-case basis. If you fail to do this, you will be permanently blacklisted.
[3.3] My art may never be used in any AI or NFTs (or related technology), and no permission will ever be granted to do so.
[3.4] Private artwork is not permitted. Art produced will remain accessible to the public and be posted to my FA, Twitter, and Bluesky with you tagged. It may also be used for example purposes or redistributed elsewhere.
[3.5] Since the artwork containing your character will be posted to the aforementioned sites, their respective Privacy Policies are listed Here for FurAffinity, Here for Twitter, and Here for Bluesky.
[3.6] If desired, I can send you a higher resolution of finished art involving your character privately. In this case, the chats or emails used to do so will be deleted on my end after seven (7) days of sending. Please treat this as a business transaction, and not an opportunity for casual chat.
[3.7] In terms of files/data, the only things retained permanently are both the final JPGs and the layered PSD files which are labelled with the character name. These are stored on a home server, a separate external HDD, and additionally backed up offsite by Backblaze B2 (Their Privacy Policy is Here). Should you lose the artwork, I can resend it on request.
[3.8] PSD files are not shared.
[3.9] If I produce art for you, I reserve the right to keep the final work displayed in my public galleries and repost elsewhere for as long as I see fit. This is non-negotiable. The artwork represents hours of my time and effort, and forms part of an overall art portfolio. Please do not ask me to remove it from display after completion. At most I'll remove any links/tags referencing you if possible, but the art itself will remain up.
4. Additional Information
[4.1] The pose used for your character may not be unique. It may be based on my previous work, inspired from other sources, or my future works may be derived from it.
[4.2] Art results may vary as I improve or experiment. I will not "paint in the style of another artist". Go commission them if you want something in their style.
[4.3] Artwork featuring your character will never be profited from or sold by me in any format without your express written permission, nor claimed to be anything other than what was originally agreed to.
[4.4] Under no circumstances shall I be liable for any indirect, incidental, consequential, special or exemplary damages arising out of or in connection with your access or use of my artwork or related services.
[4.5] Any art produced under this ToS agreement will be watermarked accordingly.
[4.6] Just because I draw it doesn't necessarily mean I'm into it. There may be some options / combinations on the Google Form that are not really "my thing", but either have been previously requested or is something that might be interesting to draw.
Acceptable Character Policy
I'm open to draw most species, any gender, and am LGBTQ+ friendly.However, I will not draw anything that involves (but is not limited to) the following:
Third party characters without the owners explicit written permission.
Characters that are not of their respective legal age or above. "Aging up" of a character is not accepted.
Overly toony or style-dependent characters, or ones that would otherwise not fit my established art style.
Human (or human-like) appearance, mechs, vehicles, or any complex machinery. Characters such as synths and protogens are fine.
Feral characters in anything other than a headshot (although dragons and synths are potentially exempt). I'm unable to draw these forms to what I feel is an acceptable quality.
Hyper / inflation / excessive muscle / extreme proportions. Nothing personal, it's simply not something I could do adequate justice or have an interest in drawing.
Cub / babyfur / diaper aspects - again, nothing personal. You do you! I just have no inclination to draw the subject.
Hate speech, libel, symbols, or anything that aims to harm or insult any person or group (racial, religion, culture, LGBTQ+, disabilities, mental health, nationalistic stereotypes etc), or any other discriminatory language that is likely to incite hatred.
Nationalistic, political, social, or religious statements and symbols.
Trademarked, copyrighted, or protected company logos, names, designs, or patterns without substantial alteration.
Trademarked, copyrighted, or protected characters, or characters belonging to a corporate entity (for example Disney, Nintendo, Sega) without substantial alteration.
Anything that is not on this list I later discover (for better or worse) and have no desire to draw. In which case I invoke the right to refuse.
